Despite the wealth of knowledge and expertise that older employees bring to their roles, studies show that older workers are frequently subjected to unfair treatment in the workplace simply because of their age.  Fortunately, older employees in California are explicitly safeguarded against employers who unlawfully commit age discrimination in the workplace. 

In California, two key sets of legislation protect workers 40 years or older.  These laws ensure that individuals 40 years of age and older are evaluated based on their abilities and achievements, not sidelined and discriminated against due to misconceptions about age.

It’s not always easy to prove age discrimination. This is because employers won’t explicitly state that you’re being treated differently because of your age. Instead, employers will take subtle or indirect actions that discriminate against you and minimize your role. Which Laws Protect Me from Age Discrimination at Work?

The California Fair Employment and Housing Act (FEHA) prohibits discrimination in all areas of employment for workers 40 years of age and older. The law applies to employers with 5 or more employees and mandates that the company refrain from discrimination in decisions such as hiring, promotion, termination, compensation, or privileges and benefits of employment (including training and other opportunities) based on age.

The Age Discrimination in Employment Act (ADEA) is a federal law that applies to employers with 15 or more employees and provides many of the same protections against age discrimination as its California FEHA counterpart.

Both sets of laws work together to provide comprehensive protections for older California employees.

Protection from Retaliation

Both the California FEHA and federal Civil Rights Act of 1964 protect employees against retaliation by their employer.  Simply put, it is illegal for your employer to retaliate against you for voicing your opposition to their discriminatory practices, or for filing a complaint about their discrimination. 

This means you cannot be fired, demoted, harassed, or subjected to any adverse employment decision simply because you exercised your rights under the law.
